Purchasing and Returning Rules

1. General provisions:

1.1. These Purchasing and Returning Rules (hereinafter – Rules) is a legally binding document for the Buyer and MB “Dangaus metro” (code of the legal entity: 3059202107, registered address: Vido Maciulevičiaus g. 24-130, LT-04308 Vilnius) (hereinafter – Seller), which defines the rights and obligations of the Parties, the conditions and the procedure for purchasing the goods, their payment, delivery and return, as well as other provisions regarding the buying and selling of goods on the online shop www.dangausmetro.lt.
1.2. The Buyer consents to these Rules by ticking the box “I agree with the Rules and the Privacy Policy”, which appears when the Buyer selects an item, puts it into a shopping cart and decides to continue their purchase.
1.3. The Seller has a right to alter, supplement and otherwise amend the Rules, following the requirements defined by the legal acts of the Republic of Lithuania.
1.4. Shopping on the online shop www.dangausmetro.lt is available to natural and legal persons through purchasing a gift voucher for a selected service.

2. Personal data protection:

2.1. Before shopping on the online shop www.dangausmetro.lt, the Buyer must provide their personal data (name, surname, address, phone number, email address) for the purchase, delivery and payment for the goods.
2.2. By agreeing to these Rules, the Buyer consents to the Seller processing their personal data provided in the registration form, for the purposes of executing the sales contract.
2.3. By agreeing to these Rules, the Buyer consents to being sent information messages, necessary for the execution of the order, payment and delivery of goods, to the email address they indicated.
2.4. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except for the Seller’s partners who deliver the goods or other services regarding proper execution of the Buyer’s order. In all other cases, the Buyer’s personal data can only be disclosed to third persons following the procedure defined by the legal acts of the Republic of Lithuania.

3. Rights of the Seller:

3.1. The Seller must ensure that the purchased services are provided in an appropriate and quality manner within 30 (thirty) days from the first request for the service.
3.2. The Seller must observe confidentiality and data protection requirements.

4. Obligations of the Buyer:

4.1. The Buyer must pay for the goods purchased and receive them following the procedure defined by these Rules.
4.2. Buyers on the online shop www.dangausmetro.lt must adhere to these Rules and the conditions which are clearly indicated in the information segments of the online shop, and respect the legal acts of the Republic of Lithuania.

5. Obligations of the Seller:

5.1. The Seller undertakes to create the opportunity to use the services of the online shop, the operation conditions of which are established by these Rules and other conditions announced on the online shop www.dangausmetro.lt.
5.2. The Seller undertakes to respect the Buyer’s right to privacy regarding their personal information.

6. Prices of goods:

6.1. The prices of goods (a ticket for a hot air balloon ride or a gift voucher) are indicated in euros on the online shop and on the confirmed order.

7. Delivery of goods:

7.1. When purchasing a gift voucher on the online shop, the Buyer can choose its mode of delivery: an electronic gift voucher or a printed version which we would send or deliver to the indicated address.

8. Return of goods:

8.1. A gift voucher, which has an expiration date of 12 months from its day of purchase, cannot be returned to the Seller or be exchanged for money based on the conditions of this Agreement.

9. Validity period and conditions of use of the gift voucher:

9.1. A gift voucher purchased by the Buyer under this Agreement expires in 12 (twelve) months.
9.2. If the Buyer fails to use the gift voucher within the validity period indicated therein, it is considered that the service defined in the voucher has been provided and money is not refunded in that case.

10. Responsibility of the Parties:

10.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form.
10.2. The Seller cannot guarantee that it will be able to deliver the service on the day requested, based on meteorological conditions.
10.3. Should there be any damage inflicted, the guilty Party reimburses the damages incurred by the other Party in accordance with the procedure and on the grounds of the legal acts of the Republic of Lithuania.

11. Confidentiality

11.1. The Seller undertakes to keep the data provided by the Buyer on the order form confidential and not to disclose it to third persons (except for third-party service providers when that is required to ensure the appropriate and timely provision of the services indicated in the gift voucher). These obligations do not apply when the disclosure of the Buyer’s data is mandatory in cases defined by the legal acts of the Republic of Lithuania.

12. Other conditions:

12.1. MB “Dangaus metro” reserves the right to withdraw, supplement and alter these Rules and other documents related to the Rules at its own discretion. Additions or alterations to the Rules enter into force on the day of their announcement.
12.2. If the Buyer disagrees with the new edition of the Rules, their partial additions or alterations, the Buyer has a right to refuse them, on the understanding that the Buyer loses their right to use the services of the online shop. These Rules have been drawn up following the legal acts of the Republic of Lithuania.

The Parties undertake to settle all disagreements regarding the execution of the Agreement by negotiation. Should any disputes or disagreements regarding the execution of the Agreement fail to be settled by negotiation within 30 days of filing the written notice, they shall be settled in a court of the Republic of Lithuania following the procedure defined by the legal acts of the Republic of Lithuania.
